The Lexington convenience store was broken into on Feb. 17, and 30 cartons of cigarettes were stolen, according to a Lexington Police Department report.
The restaurant was a revival of one that previously closed under different owners.
A Lexington police detective testified that the deal started to fall apart, and the victim was shot three times in the chest.
