A new emergency appeal is yet another step by the White House to assert sweeping presidential control over executive branch agencies.

President Donald Trump’s administration on Wednesday asked the Supreme Court to step in on an emergency basis to permit the firing of three members of the Consumer Product Safety Commission, as the White House continues to attempt to assert more control over independent agencies.

After being notified in May that Trump had fired them, Boyle, Hoehn-Saric and Trumka sued to challenge the action. Commissioners of independent agencies established by Congress such as the Consumer Product Safety Commission can be removed by the president only for neglect of duty or malfeasance, not at will, their lawsuit noted.
